Terms of Use

1. Agreement to these Terms

These Terms of Use (“Terms”) form an agreement between you and EpanLabs LLC (“EpanLabs,” “we,” “us,” or “our”). They govern your access to and use of epanlabs.com, Accountability Pulse, and other EpanLabs products or services that link to these Terms (collectively, the “Services”).

By accessing or using a Service, you agree to these Terms. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old to use Accountability Pulse. By using it, you represent that you meet this requirement and have the legal capacity to agree to these Terms. Other Services may state additional or different eligibility requirements.

3. The Services

EpanLabs develops software, media, and AI-assisted products. Accountability Pulse is a self-directed Telegram bot that allows users to create goals, schedule check-ins, and record progress.

Some Services may have supplemental terms, product notices, pricing terms, or policies. If supplemental terms conflict with these Terms, those supplemental terms govern for the relevant Service.

4. Your account and Telegram

Accountability Pulse is accessed through Telegram. You are responsible for maintaining control of your Telegram account and for activity conducted through it.

Telegram is a third-party platform that EpanLabs does not own or control. Your use of Telegram is also governed by Telegram’s own terms and privacy policy. EpanLabs is not responsible for Telegram’s availability, security, retention practices, account actions, or platform changes.

5. User content

You may submit goals, success criteria, messages, check-in updates, and other content (“User Content”). You retain ownership of your User Content.

You grant EpanLabs a limited license to host, process, reproduce, and transmit User Content only as reasonably necessary to provide, operate, maintain, secure, and troubleshoot the Services.

You are responsible for your User Content and for ensuring that you have the right to submit it. Do not include another person’s confidential information or sensitive personal information that is not necessary for your use of the Service.

6. Acceptable use

You may not use, or attempt to use, the Services to:

• Violate any law or another person’s rights.
• Submit unlawful, fraudulent, threatening, abusive, or intentionally harmful content.
• Impersonate another person or misrepresent your affiliation.
• Attempt to gain unauthorized access to the Services or another user’s information.
• Interfere with, disrupt, reverse engineer, scrape, or overload the Services except where applicable law expressly permits.
• Use automated means to abuse, probe, or circumvent usage limits or security controls.
• Distribute malware, malicious code, or content intended to compromise systems or accounts.
• Manipulate billing systems, create multiple accounts to evade subscription or usage limits, use unauthorized payment methods, or otherwise attempt to avoid applicable fees.

7. Self-directed tool; no professional services

Accountability Pulse is a self-directed accountability tool. It does not provide human coaching, therapy, medical care, diagnosis, treatment, crisis support, legal advice, financial advice, or other professional services.

Do not rely on the Services for emergencies or urgent professional assistance. Contact appropriate emergency services or a qualified professional where needed.

8. No guaranteed outcomes

The Services may help users organize commitments and record progress, but EpanLabs does not guarantee that you will complete a goal, build a habit, improve performance, or achieve any particular result. Your decisions and actions remain your responsibility.

9. AI-generated output

Some Services use artificial intelligence to generate responses, summaries, or observations. AI-generated output may be incomplete, inaccurate, inappropriate, repetitive, or unsuitable for your circumstances.

You are responsible for reviewing and deciding whether to rely on any output. Do not treat AI-generated output as professional advice or as a substitute for your own judgment.

10. Privacy

Our collection and use of information are described in the EpanLabs Privacy Policy. By using the Services, you acknowledge that information will be processed as described there.

11. Intellectual property

The Services, including their software, designs, branding, text, interfaces, and other materials provided by EpanLabs, are owned by EpanLabs or its licensors and are protected by applicable intellectual-property laws.

Subject to these Terms, EpanLabs grants you a limited, personal, revocable, non-exclusive, non-transferable license to use the Services for their intended purpose. No other rights are granted.

“EpanLabs” and “Accountability Pulse,” together with associated logos and branding, may not be used without permission except as permitted by law.

12. Feedback

If you provide suggestions or feedback, you grant EpanLabs permission to use it without restriction or compensation, provided that we do not publicly identify you as the source without your permission.

13. Availability, changes, and termination

We may add, remove, modify, suspend, limit, or discontinue any part of the Services. We do not guarantee that a Service will always be available, uninterrupted, secure, or error-free.

We may suspend or terminate access where we reasonably believe a user has violated these Terms, created risk for the Services or others, or where suspension is needed for legal, security, or operational reasons.

You may stop using the Services at any time. Accountability Pulse users may use /delete_data to delete their data from EpanLabs’ active application databases, subject to the residual-retention details in the Privacy Policy.

14. Third-party services

The Services may depend on or link to third-party platforms, hosting providers, AI providers, or other services. EpanLabs does not control those third parties and is not responsible for their content, availability, terms, privacy practices, or actions.

Your use of third-party services may be governed by separate agreements between you and the relevant provider.

15. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” EPANLABS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

EPANLABS DOES NOT WARRANT THAT THE SERVICES WILL BE ACCURATE, COMPLETE, UNINTERRUPTED, SECURE, ERROR-FREE, OR SUITABLE FOR YOUR PARTICULAR NEEDS.

Some jurisdictions do not allow certain warranty exclusions, so some of the exclusions above may not apply to you.

16. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EPANLABS LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EPANLABS’ TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID EPANLABS FOR THE RELEVANT SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US$100.

These limitations do not apply where prohibited by law.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless EpanLabs LLC and its members, managers, employees, contractors, and agents from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful use of the Services, your User Content, or your material violation of these Terms.

18. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law principles.

Nothing in these Terms limits any non-waivable consumer right or remedy available under applicable law.

19. Changes to these Terms

We may update these Terms as the Services or applicable requirements change. The “Last updated” date at the top of the page will show when they were most recently revised.

Where required, we will provide additional notice of material changes. Your continued use of the Services after updated Terms take effect constitutes acceptance of the updated Terms, to the extent permitted by applicable law.

20. General provisions

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. EpanLabs may assign these Terms as part of a merger, acquisition, reorganization, asset transfer, or by operation of law.

These Terms and any applicable supplemental terms constitute the entire agreement between you and EpanLabs concerning the Services.
